1. About these Terms

These Terms of Service (“Terms”) apply to pacificstonesolutions.com, kitchens.pacificstonesolutions.com and any other website we operate (together, the “Sites”), and to the Pacific Stone text messaging program. “Pacific Stone,” “we,” “us” and “our” mean Pacific Stone Creations LLC. By using the Sites or opting in to text messages, you agree to these Terms. Our Privacy Policy explains how we collect and use your information.

2. Text Messaging (SMS) Terms

Program name: Pacific Stone Text Messaging

Program description: Pacific Stone Creations LLC (Pacific Stone) sends text messages to people who request information or an estimate from us, and to our customers. We send two kinds of messages:

• Customer care messages: replies to your questions, estimate and showroom appointment scheduling and reminders, follow-ups on your estimate request, and updates about your kitchen, cabinet or countertop project.
• Marketing messages: promotions, special offers and news about Pacific Stone products and services. You receive these only if you separately agree to marketing texts.

How you opt in:

• By checking a text message consent box on a form on our Sites where one is offered. Customer care texts and marketing texts each have their own box, and neither box is required to submit a form.
• By texting us first. We will reply, and you may receive customer care messages about your request.
• By telling a Pacific Stone team member by phone that you agree to receive customer care texts. We do not use verbal consent for marketing texts.

Consent to receive text messages is not a condition of any purchase.

Message frequency: Message frequency varies.

Cost: Message and data rates may apply.

Opting out: Text STOP to cancel at any time. You can also reply STOPALL, UNSUBSCRIBE, CANCEL, END or QUIT. After you text STOP, we will send one message confirming that you have been unsubscribed. After that, you will no longer receive text messages from us unless you opt in again. To opt back in, reply START. If you want to stop marketing texts but keep customer care texts about your project, call or email us and we will update your preferences.

Carrier disclaimer: Carriers are not liable for delayed or undelivered messages.

Your phone number: You must be at least 18 years old to opt in. You confirm that you are the account holder or an authorized user of the mobile number you provide. If you change or give up that number, please text STOP from it first or let us know.

Privacy: We do not sell or share your mobile number or text message consent with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. We share information only with service providers that help us deliver messages, such as our messaging platform and wireless carriers, and only to provide this service. 3. Prices, estimates and our work

Prices, starting prices, financing examples and timelines shown on our Sites are estimates for general information. They are not offers. Final pricing, scope and schedule depend on measurements, cabinet configuration, material selections and any additional work required, and are set only in a signed written agreement with Pacific Stone. Financing is provided by third-party lenders and is subject to credit approval and the lender’s terms.

Kitchen remodeling, cabinet and countertop work is governed by the written contract you sign with us. If these Terms conflict with that contract, the contract controls. CSLB License #1066730.

4. Information you submit

When you submit a form, photos or other information through our Sites, you confirm that it is accurate and that you have the right to share it. You allow us to use it to respond to you, prepare an estimate and provide our services, as described in our Privacy Policy.

5. Acceptable use

Please do not use the Sites for any unlawful purpose, submit false information, attempt to access systems or data you are not authorized to access, interfere with how the Sites work, or copy content from the Sites by automated means.

6. Our content

The Sites, including text, photos, logos and design, belong to Pacific Stone or its licensors. You may view and share pages for personal, non-commercial use. Any other use requires our written permission.

7. Third-party services

Our Sites may link to or use third-party services such as maps, review sites, financing providers and social media. We are not responsible for their content or practices, and their own terms and privacy policies apply.

8. Disclaimers

The Sites are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, about the Sites, including warranties of merchantability, fitness for a particular purpose and non-infringement. This section does not limit any warranty included in a written contract for our work.

9. Limitation of liability

To the fullest extent permitted by law, Pacific Stone is not liable for any indirect, incidental, special or consequential damages arising from your use of the Sites or the text messaging program. Nothing in these Terms limits liability that cannot be limited under California law.

10. Governing law

These Terms are governed by the laws of the State of California.

11. Changes to these Terms

We may update these Terms from time to time. The effective date at the top of this page shows when they were last changed. Continuing to use the Sites or the text messaging program after an update means you accept the updated Terms.
